Waste Collection Brompton Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Brompton provides waste collection and related services to domestic and commercial customers in the United Kingdom. By placing a booking, you agree that you have read, understood, and accepted these Terms and Conditions. If you do not agree, you must not use our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company, or organisation requesting waste collection services from Waste Collection Brompton.

Services means waste collection, clearance, removal, loading, transport, and associated activities carried out by Waste Collection Brompton.

Waste means any items, materials, refuse, rubbish, or unwanted goods presented by the Customer for collection, subject to applicable waste regulations.

Contract means the agreement between Waste Collection Brompton and the Customer for the provision of Services, incorporating these Terms and Conditions.

2. Scope of Services

Waste Collection Brompton provides scheduled and ad hoc waste collection services, including household waste removal, commercial waste collection, bulky item removal, and general rubbish clearance. The precise scope of the Services will be set out in your booking confirmation, including the estimated volume or weight of waste, type of waste, collection date, collection location, and applicable charges.

The Customer is responsible for accurately describing the type and quantity of waste to be collected at the time of booking. Waste Collection Brompton reserves the right to decline to collect any waste that is unsafe, not as described, or not compliant with current waste regulations.

3. Booking Process

3.1 Booking requests may be made by telephone, email, online form, or any other approved method advertised by Waste Collection Brompton. A Contract is formed only when Waste Collection Brompton confirms acceptance of your booking, whether verbally or in writing.

3.2 At the time of booking, the Customer must provide accurate information including, but not limited to:

a. Full name and contact details of the Customer.

b. Collection address and any access requirements.

c. Preferred collection date and time window.

d. Description of the waste, including type, approximate volume, and any special handling requirements.

3.3 Waste Collection Brompton will provide an estimated price based on the information supplied. This estimate may be revised where the actual waste differs from the description provided or where access difficulties or additional services are required.

3.4 The Customer must ensure that a responsible adult is present at the collection address at the agreed time, unless otherwise agreed in advance. If no one is present and access has not been pre-arranged, the collection may be treated as a missed appointment and charges may apply.

4. Prices and Quotations

4.1 All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless expressly stated otherwise.

4.2 Any quotation provided is an estimate based on the information supplied by the Customer. If the actual volume, weight, or nature of the waste differs from that described, or if access is more difficult than anticipated, Waste Collection Brompton reserves the right to adjust the price accordingly.

4.3 Surcharges may apply for particular types of waste, especially items that require special disposal procedures, such as electrical goods, appliances containing refrigerants, tyres, or other regulated or hazardous materials.

5. Payments and Invoicing

5.1 Payment is due in accordance with the terms notified to you at the time of booking. Unless otherwise agreed, payment is due either in advance or immediately upon completion of the collection.

5.2 Waste Collection Brompton may accept payment by cash, card, bank transfer, or other methods specified to you. The accepted payment options may vary from time to time.

5.3 For business Customers, credit terms may be agreed in writing at the sole discretion of Waste Collection Brompton. If credit terms are granted, invoices shall be payable within the period stated on the invoice. If no period is stated, invoices are due within 14 days of the invoice date.

5.4 If the Customer fails to make any payment on the due date, Waste Collection Brompton reserves the right to:

a. Charge interest on the overdue amount at the statutory rate permitted in the United Kingdom, accruing daily until payment is made in full; and

b. Suspend or cancel any future collections or Services for the Customer.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving Waste Collection Brompton reasonable notice prior to the agreed collection time. The required notice period will normally be specified at the time of booking.

6.2 If the Customer cancels a booking within the specified free-cancellation period, no cancellation charge will usually apply. If the Customer cancels with insufficient notice, a cancellation fee may be charged to cover administrative and operational costs.

6.3 If Waste Collection Brompton arrives at the collection address at the agreed time but is unable to complete the collection due to reasons within the Customer s control, including lack of access, absence of a responsible person if required, or misdescription of waste, the visit may be treated as a missed appointment and a call-out charge may be applied.

6.4 Waste Collection Brompton reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, adverse weather, staff illness, or compliance with legal or regulatory requirements. In such cases, Waste Collection Brompton will aim to notify the Customer as soon as reasonably practicable and will offer a revised collection time. Waste Collection Brompton shall not be liable for any loss or damage arising from such cancellation or rescheduling, other than a refund of any pre-paid amount for Services not carried out.

7. Customer Responsibilities

7.1 The Customer must ensure that:

a. The waste is properly presented for collection as instructed by Waste Collection Brompton.

b. The collection address is safe and accessible for Waste Collection Brompton personnel and vehicles.

c. Any necessary permissions or consents, such as from landlords, managing agents, or local authorities, are obtained in advance.

7.2 The Customer must not present for collection any hazardous or prohibited waste, including but not limited to asbestos, clinical waste, chemicals, flammable substances, gas cylinders, or any materials classified as hazardous under applicable laws, unless Waste Collection Brompton has specifically agreed in writing to handle such waste and all additional requirements and charges have been accepted by the Customer.

7.3 The Customer is responsible for ensuring that no items intended to be retained are inadvertently presented as waste. Once collected, waste may be mixed, compacted, or processed and cannot usually be retrieved.

8. Waste Regulations and Compliance

8.1 Waste Collection Brompton operates in accordance with applicable UK waste management legislation and guidance. All waste collected will be transported and disposed of through appropriate and authorised channels.

8.2 The Customer confirms that they have the right to transfer the waste to Waste Collection Brompton and that the waste does not include any items or materials that are illegal to possess, transfer, or dispose of under UK law.

8.3 For commercial Customers, statutory documentation such as waste transfer notes may be issued where required by law. The Customer must retain their copy of any such documentation for the periods specified under applicable regulations.

8.4 The Customer agrees to cooperate with Waste Collection Brompton in relation to any regulatory or compliance queries, audits, or investigations relating to the waste collected under these Terms and Conditions.

9. Access and Property Damage

9.1 The Customer must ensure that Waste Collection Brompton has clear and safe access to the waste at the collection address. This includes ensuring that driveways, entrances, stairways, lifts, and hallways are unobstructed.

9.2 While reasonable care will be taken when carrying out collections, the Customer acknowledges that movement of heavy or bulky items, and the operation of vehicles and equipment, may carry a risk of minor damage. Waste Collection Brompton shall not be liable for damage to driveways, paths, or surfaces caused by the weight or movement of vehicles where the Customer has requested that such vehicles access the premises.

9.3 The Customer is responsible for protecting any areas or items that may be particularly susceptible to damage. If the Customer asks Waste Collection Brompton to carry items through or from areas with restricted access, or over surfaces that may be easily marked or damaged, the Customer accepts the associated risks.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude Waste Collection Brompton s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be limited or excluded under UK law.

10.2 Subject to clause 10.1, Waste Collection Brompton shall not be liable to the Customer for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the provision of the Services.

10.3 Subject to clause 10.1, the total aggregate liability of Waste Collection Brompton to the Customer in respect of any claim or series of connected claims arising out of or in connection with the Services shall be limited to the total amount paid by the Customer for the specific Services giving rise to the claim.

10.4 Waste Collection Brompton shall not be responsible for any delays or failure to perform any part of the Services where such delay or failure is due to events beyond its reasonable control, including but not limited to acts of God, extreme weather, strikes, lockouts, industrial disputes, accidents, road closures, or compliance with legal or regulatory requirements.

11. Complaints

11.1 If the Customer wishes to make a complaint about any aspect of the Services, they should contact Waste Collection Brompton as soon as practicable, providing full details of the issue.

11.2 Waste Collection Brompton will investigate complaints in a timely and fair manner and may request additional information or evidence from the Customer. Where appropriate, Waste Collection Brompton will seek to agree a reasonable resolution with the Customer.

12. Data Protection and Privacy

12.1 Waste Collection Brompton will collect and process personal data about Customers in order to provide the Services, administer bookings, and manage accounts in accordance with applicable data protection laws in the United Kingdom.

12.2 By using the Services, the Customer consents to the collection and use of their personal information for these purposes. Waste Collection Brompton will not sell personal data to third parties and will only share personal data where necessary to provide the Services, to comply with legal obligations, or with the Customer s consent.

13. Termination

13.1 Either party may terminate the Contract with immediate effect by giving written notice if the other party commits a material breach of these Terms and Conditions and, where such breach is capable of remedy, fails to remedy it within a reasonable period after being notified.

13.2 Waste Collection Brompton may terminate the Contract or suspend Services immediately if the Customer fails to pay any amount due, becomes insolvent, or is otherwise unable to meet its obligations as they fall due.

14. Variations to these Terms

14.1 Waste Collection Brompton reserves the right to amend or update these Terms and Conditions from time to time to reflect changes in law, best practice, or the nature of the Services.

14.2 The current version of the Terms and Conditions at the time of your booking will apply to the Contract governing that booking. If changes are made that materially affect your rights or obligations for ongoing Services, Waste Collection Brompton will take reasonable steps to inform you.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any Contract between Waste Collection Brompton and the Customer, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the Services provided.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.

16.2 No failure or delay by Waste Collection Brompton to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 The Customer may not assign, transfer, or subcontract any of their rights or obligations under the Contract without the prior written consent of Waste Collection Brompton. Waste Collection Brompton may assign or subcontract its rights and obligations where reasonably necessary for the provision of the Services.

16.4 These Terms and Conditions constitute the entire agreement between Waste Collection Brompton and the Customer in relation to the Services and supersede any prior understandings or agreements, whether written or oral.
